Terms of Service

These Terms of Service ("Terms") govern your use of Eternal Capsule, operated by Magic Labs LLC ("Eternal AI," "we," "us," or "our") at capsule.eternal.ai. By creating an account or using our services, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Eternal Capsule. By using our services, you represent that you meet this age requirement. If you are between 13 and 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

2. Account Registration

You must create an account to use Eternal Capsule. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating your account and to update it as needed.

3. Description of Services

Eternal Capsule is an AI-powered platform that helps you capture your life story through voice interviews with an AI interviewer. Your conversations are used to generate professional biographies, and in the future, other legacy artifacts such as movies, podcasts, and digital avatars.

Free Trial: New users receive 20 minutes of free interview time. After the free trial, you must purchase a product to continue interviewing.

Paid Products: We offer paid products including digital eBook biographies. Prices are displayed at the time of purchase. We may introduce additional products in the future.

4. Purchases and Payments

All purchases are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

Prices are in US dollars and are subject to change. Any price changes will not affect purchases already completed.

Promotional codes and discounts may be offered at our discretion and may be subject to additional terms.

5. Refund Policy

Before biography generation: If you have purchased a digital eBook biography but have not yet generated it, you may request a full refund within 14 days of purchase.

After biography generation: Once a biography has been generated, purchases are non-refundable. The generation process consumes significant computational resources that cannot be recovered.

To request a refund, contact us at hello@eternal.ai with your account email and purchase details.

6. Content Ownership

Your Content: You retain full ownership of all personal content you provide to Eternal Capsule, including your voice recordings, transcripts, photos, and biographical information. You grant us a limited license to use this content solely for the purpose of providing our services to you (conducting interviews, generating biographies, and producing related artifacts).

Generated Content: Biographies and other content generated by our AI systems from your interviews are owned by you. You may download, share, print, and use your generated content for any personal purpose.

Our Services: We retain ownership of the Eternal Capsule platform, software, AI models, design, and branding. Nothing in these Terms transfers ownership of our intellectual property to you.

7. AI-Generated Content

Eternal Capsule uses artificial intelligence to conduct interviews, generate biographies, and produce other content. You acknowledge that:

• All generated content is produced by AI and may contain errors, inaccuracies, omissions, or misrepresentations
• You are responsible for reviewing, editing, and verifying the accuracy of any generated content before sharing, publishing, or printing it
• We do not guarantee that generated content will be complete, accurate, or suitable for any particular purpose
• Generated content is based on information you provide during interviews — the quality of the output depends on the depth and accuracy of your input

8. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or its infrastructure
• Use automated scripts, bots, or tools to access the service (except as we may explicitly permit)
• Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate another person or misrepresent your identity
• Attempt to reverse-engineer, decompile, or extract source code from our software
• Resell, redistribute, or commercially exploit the service without our written permission
• Abuse the interview system by consuming excessive resources (interviews are capped at 20 hours per capsule)

9. Account Termination

You may delete your account at any time from your account settings. Upon deletion, your account and capsule data will be removed from our active systems as described in our Privacy Policy.

We reserve the right to suspend or terminate your account if you violate these Terms, engage in abusive behavior, or use the service in a way that harms other users or our operations. We will make reasonable efforts to notify you before termination except in cases of severe or repeated violations.

10. Limitation of Liability

To the maximum extent permitted by law, Magic Labs LLC and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Eternal Capsule, including but not limited to:

• Loss of data, content, or recordings
• Errors or inaccuracies in AI-generated content
• Service interruptions or downtime
• Unauthorized access to your account due to your failure to maintain credential security

Our total liability for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

Eternal Capsule is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or secure, or that any defects will be corrected.

12. Indemnification

You agree to indemnify and hold harmless Magic Labs LLC and its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any third party's rights.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the service shall be resolved in the courts located in Johnson County, Kansas.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of Eternal Capsule after changes are posted constitutes your acceptance of the updated Terms.
